Q. What is the difference between a Living Will and a Living Trust? I’ve heard different answers.

A. A Living Will (also known as an Advance Directive) is a document that sets forth your wishes for the treatment or non-treatment one wishes to receive in the event of some catastrophic event. A Living Trust is an entirely unrelated document. Its purpose is to establish a method of transferring assets at the passing of the person who created the Living Trust. Theoretically a Living Trust is one form of probate avoidance mechanism.
